Village of Oak Creek HOA Rental Ban Ruling, Explained

The VOCA short-term rental ban was declared unenforceable in April 2026. What happened, what it means for buyers, and why sub-HOAs still matter.

For nearly a decade, the Village of Oak Creek (VOC) was largely off the table for Airbnb investors. That changed in 2026. Here is a plain-English timeline and what it means if you are thinking about buying.

The short version

  • 2017: The Village of Oak Creek Association (VOCA), the master HOA, amended its rules to ban rentals of less than 30 days.
  • 2024: In Kalway v. Calabria Ranch HOA, Arizona courts limited an HOA’s ability to impose new, unforeseeable restrictions after owners bought. The Arizona Supreme Court declined review on April 2, 2024, letting that ruling stand.
  • April 18, 2026: VOCA announced that its 2017 short-term rental ban is unenforceable. A written member statement followed on May 6, 2026.
  • July 22, 2026: The VOCA board tabled a proposed STR monitoring program.

What it means for buyers

Homes under only the VOCA master association can, in many cases, now be considered for short-term rental use, subject to Yavapai County rules. Because VOC is unincorporated, there is no city permit. You still need an Arizona TPT license, assessor registration, and a structure permitted for habitation.

VOC homes have historically sold for about 20–25% less per square foot than West Sedona, according to Own In Sedona. Market data from GuestFavorites shows roughly 579 listings, 55% occupancy, and about $60K in average annual revenue. Watch whether that price gap narrows.

Why sub-HOAs still matter

Many VOC neighborhoods have their own sub-association with separate CC&Rs. Sedona Golf Resort, Pinon Woods, Firecliff, and Las Piedras are among those reported to still restrict rentals. A restriction that was in the original recorded documents is treated differently from one added later. That’s why we pull and read the full document chain, with recording dates, before an offer.

How we evaluate a VOC property

  1. Identify every association the parcel belongs to.
  2. Pull CC&Rs and amendments with recording dates.
  3. Confirm permitted habitable structures with the county.
  4. Run comparables and the STR calculator with the VOC preset.
